OKON EFRETI ABANG, JCA (Delivering the Leading Judgement): This is an appeal against the decision of the National and State Houses of Assembly Election Petition Tribunal sitting in Jos in a Judgment delivered on 11/9/2023.
The Appellant was the 2nd Respondent, the 1st and 2nd Respondents were the 1st and 2nd Petitioners while the 3rd & 4th Respondents were the 1st and 3rd Respondents respectively. The facts that gave rise to this appeal are that the 4th Respondent conducted election into the office of Member representing Borkin Ladi/Ryom Federal Constituency in the House of Representatives on the 25/2/2023. In the said election, the 3rd Respondent sponsored the appellant while the 2nd Respondent sponsored the 1st Respondent. At the end of the election, the 4th Respondent declared the Appellant winner of the election and accordingly returned.
