MARY UKAEGO PETER-ODILI.JSC (Delivering the Leading judgment): The appellant was convicted and sentenced to death by the judgment of the High Court of Lagos state dated 3rd March, 2011 for the offence of conspiracy to commit armed robbery and armed robbery contrary to Sections 403 (a) and 402 (20(a) of the Criminal code, Cap C.17 Vol.2, Law of Lagos State 2003 per M.A. Dada J.

The appellant dissatisfied appealed to the Court of Appeal or court below or lower court, Coram: A.A. Augie JCA (as he then was), J.S. Ikyegh and C.E. Iyizoba JJCA, wherein the conviction for the lesser offences of conspiracy to commit armed robbery and armed robbery were substituted with conviction for lesser offences of conspiracy to commit armed robbery and robbery contrary to Sections 403(A) and 402(1) of the Criminal code laws of Lagos State, 2003.
