UWANI MUSA ABBA AJI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of Honourable Justice S. Yahuza of the Federal High Court Sitting in Dutse, Jigawa State, in Charge No.FHC/DT/CR/37/2017, delivered on 3/5/2017, wherein the Appellant was convicted and sentenced to 2 years imprisonment for possession of 99 grams of Tramadol tablets, a psychotropic substance without lawful authority.
The charge against the Appellant contained at page 1 of the records in the Charge Sheet dated 25/4/2017 reads as follows:
That you, Idris Akilu (a.k.a Auta) (M), adult of Madakanci Quarters in Birnin Kudu Local Government Area of Jigawa State, on or about the 10th April, 2017 at about 3:00am at your residence in Birnin-Kudu within the jurisdiction of this Honourable Court and without lawful authority had in your possession 99 grammes of Tramadol tablets, a psychotropic substance and thereby committed an offence contrary to Section 20(1)(c) and punishable under Section 20(2)(b) …
