MUHAMMED LAWAL SHUAIBU, J.C.A. (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of Ondo State, Akure Judicial Division, presided over by Hon. Justice W. R. Olamide delivered on 14th February, 2023 wherein the Appellant (the 1st Defendant) and his co-defendant were convicted for Conspiracy and Murder and were accordingly sentenced to seven years imprisonment and death by hanging.
By an amended information filed on 12th November, 2021, the Appellant and his co-defendant were arraigned at the lower Court on five counts charge of Conspiracy to commit Armed Robbery, Armed Robbery and Murder, contrary to and punishable under Sections 6(6)(b), 1(2)(a) and (b) of the Robbery and Firearms (Special Provisions) Act, Cap R11, Vol. 14 of the Laws of the Federation of Nigeria, 2004, Sections 324, 316 and 319(1) of the Criminal Code Cap 37, Vol. I, Laws of Ondo State of Nigeria, 2006.
