HUSSEIN MUKHTAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Anambra State delivered on 5th July 2012 wherein the N1, 000,000.00 was awarded as compensation with cost of N20,000.00 against the appellant in favour of the respondent.
The respondent filed an application for the enforcement of his Fundamental Right on the 17th of November 2011 (See pages 7-28 of the record).
The appellant with other respondents also filed their papers in opposition to the respondents application. The parties adopted their various processes. On 5th July, 2012 the Court below delivered its decision in favour of the respondent. (See pages 150 - 155 of the record). Dissatisfied with that decision, the appellant filed a Notice of Appeal on the 12th July, 2012 based on the following two grounds:
1. That the learned trial Judge erred in law when he held that the appellant instigated the 3rd respondent to arrest and violate the respondent's fundamental right.
