UWANI MUSA ABBA AJI, JSC (Delivering the Leading Judgment): Preparatory to the 2023 general elections, the 1st Respondent conducted its primary election for the nomination of its Abia State Gubernatorial candidate on 25/5/2022. The said primary election produced Prof. Uchenna Ikonne as the candidate of the 1st Respondent. Unfortunately, Prof. Uchenna Ikonne died on 25/01/2023. With the death of Prof. Uchenna Ikonne, the 1st Respondent on 4/02/2023, conducted a fresh primary election which produced the 3rd Respondent, Ambrose Ahiwe, as the new Ahia State Gubernatorial candidate of the 1st Respondent in the 2023 general elections. Consequentially, the 3rd Respondent nominated the 4th Respondent, Chukwudiebube Jasper Uche, as his running mate for the election.
