SAMUEL CHUKWUDUMEBI OSEJI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Lagos State, Ikeja Division, delivered by B.A Oke-Lawal J. on the 19th day of June 2013 and which Judgment was given in favour of the claimants (now Respondents).

The Respondents as claimants in the Lower Court had by their amended writ of Summons and Statement of claim dated 7-7-2011 claimed against the Defendants (now Appellants) as follows:-

"(i) A Declaration that the claimants are the owners and are entitled to the Statutory Right of Occupancy on the land at 17A (Old 8) Ramlat Timson Street, Surulere Local Government Area of Lagos State. Containing an area of approximately 612.865 square meters, more particularly delineated and show on survey plan No AL10/1980.

(ii) A perpetual injunction restraining the Defendant, her agents, privies or otherwise from further acts of trespass on the claimants Land.

(iii) Possession of the land.

(iv) N1000, 000.00 …
