MUKHTAR JCA (Delivering the Lead Judgment): In the Rukuba Grade 1 Area Court, the plaintiff (who is now the respondent in this appeal) instituted an action from which this appeal emanated, for declaration of title to land. The plaintiff ’s claim as stated by him reads thus: “I, Mr. Dominic Alibidi hereby sue one Aditik Imil for encroaching into my farm and he started to build his house in 1990 ... I therefore summoned him before this court to eject him out of my premises because the place belongs to me and not him. I bought the place from one Aku at the sum of N16.00 in 1969. Since I bought it I have been using it for growing my crops. I have been getting the fruits of the locust beans tree every year. One company by name Kasamia Co. gave me an appointment over their lease No. 16524. I gave them this very land in 1974 and 1975 as their residence.
