MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Lagos State High Court in the Respondent's Suit No. ID/1627/2000 delivered on the 27th September, 2012 in her favour. The Appellants' notice of appeal against the decision was dated and filed on the 4th October, 2012, to which additional grounds of appeal were filed on 28th November, 2012 to make up a total of seven (7) grounds of dissatisfaction with the decision.

In the Appellants' brief filed on the 14th June, 2016 four (4) issues were raised for determination in the appeal as follows:-

"ISSUE 1

Whether the learned trial Judge had the jurisdiction to hear and determine the case to judgment in view of the law validly made ousting the jurisdiction of the trial Court before the conclusion of the hearing? This turns on Ground 1 of the Grounds of Appeal.
