GUMEL JCA (Delivering the Lead Ruling): This ruling is in respect of motion on notice brought by an interested party/applicant. The motion was dated and filed on 5 November 2007. It was brought pursuant to section 243(a) of the Constitution of the Federal Republic of Nigeria, 1999, Order 7, rules 1, 2 and 7 of the Court of Appeal Act, 2004 and under the inherent jurisdiction of this court. It seeks for the following reliefs:-

(1) An order of this honourable court granting leave to the applicant (Alhaji K.T. Turaki SAN) to appeal as a party interested against the decision of Kebbi State National Assembly/ Governorship and Legislative Houses Election Tribunal in petition No. KB/EPT/GOV/1/2007, delivered on 20 October 2007.

(2) An order of this honourable court deeming the notice of appeal, attached to this application as properly filed and served, the appropriate filing fees having been duly paid; and
