RULING 

By its application filed on the 25th of November 2024, the Applicant prays the Honourable Court to commit the Respondent for contempt on the following grounds; 

i. willfully disobeying the orders of the District Court 2 Tamale as contained its Judgment dated the 11th of November 2024. 

ii. willfully bringing the administration of Justice into disrepute by proceeding with construction despite the pendency of the application for contempt, 

The basis for the present application stems from a judgment of the District Court 2 Tamale dated the 11th of November 2024, by which the District Court made the following orders; 

a. I declare that neither Plaintiff nor 2nd Defendant has a BOT Agreement with the l5th Defendant 

b. I find that 2nd Defendant, per Exhibit 16, was allocated a separate site at the frontage of PWD’s yard , measuring 66.00m2. The exact dimensions of the 66.00m2 , the 1st Defendant to clarify for 2nd Defendant
