JAURO JCA (Delivering the Lead Ruling): The applicants herein brought this application pursuant to a motion on notice dated 23 January 2009 and filed on 26 January 2009 praying this courtfor the following orders: “(1) An order for leave to substituteAlhaji Bashiru Ismail Bashorun and Alhaji (Chief) Sikiru Alabi Macfoy, the applicants herein , respectively for Alhaji (Imam) Abdul Lateef Adams and Alhaji (Chief) Abdul Wahab Iyanda Folawiyo, who were respectively the 2nd and 3rd defendants/appellants herein but who are now both deceased. (2) And such further order or orders as this honourable court may deem fit to make in the circumstances.”
