RULING

BACKGROUND

[1] The applicant, the Independent Electoral and Boundaries Commission (IEBC), filed an application to this Court on 16^th September, 2014 seeking the following Orders:

(i) that this application be certified as urgent for purposes of granting prayers 2 and 3 herein;

(ii) that a conservatory Order of stay of the Judgement and Orders of the Court of Appeal issued in Civil Appeal No. 200 of 2013, on 20^th December, 2013 do issue pending the hearing and determination of the application herein inter partes;

(iii) that a conservatory Order of stay of the proceedings in the Court of Appeal in Civil Application No. NAI 140 of 2014 (UR 113 of 2014) do issue pending the hearing and determination of the application herein inter partes;

(iv) that the Court be pleased to extend time and to grant leave to the applicant to lodge its notice of appeal, and serve the same upon the respondents within 7 days;

(v) that there be stay of execution of the entire Judgement and Orders of the Court of …
