ABBA BELLO MOHAMMED, JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the judgment of the Federal High Court, Abuja Division, delivered by Hon. Justice I. E. Ekwo on the 8th of July, 2022 in Suit No. FHC/ABJ/CS/1530/2021 – DANIEL OKO v INSPECTOR-GENERAL OF POLICE & 4 ORS. The 1st Respondent who was the Applicant before the trial court filed an Originating Motion on Notice on 2nd December, 2021, wherein he sought to enforce his fundamental rights against the Appellants and 2nd Respondent, who were the Respondents. In response to the action, the 1st Respondent filed counter affidavit accompanied with a written address. The Appellants filed a preliminary objection to the competence of the action and the jurisdiction of the trial court to entertain the action. The preliminary objection was supported by an affidavit and written address.
