JUDGMENT 

The triable issues set down for determination per the application for directions taken  after close of pleadings are: 

1. Whether or not the 2nd defendant has any interest or title in the land covered  by the plaintiff’s Land Certificated dated 19th July 2012. 

2. Whether or not there was ever a valid transfer of interest in the land by the  1st defendant or a lease of the 1st defendant to the 2nd defendant. 

3. Whether or not the 2nd defendant was in possession or control of the land  since 28th June 2002 as alleged. 

4. Whether or not the plaintiff acquired a valid legal title without notice of  any conflicting title or interest.

5. Whether or not the 1st defendant has the power or authority to cancel the  plaintiff’s Land Title Certificate and to re-allocate the land covered thereby  to the 2nd defendant. 

6. Whether or not plaintiff is entitled to its claims against the defendants.
