(Delivering the Lead Judgment): This appeal is against the judgment of the Court of Appeal sitting in the Kaduna Judicial Division and delivered on the 30th of June, 2014 in Appeal No CA/K/66C/2014, and which affirmed the conviction and sentence passed on the Appellant by the High Court of Katsina State in a judgment delivered in Case No KTH/DM/2C/2006 on the 20th of November, 2012. 

The Appellant was arraigned before the High Court of Katsina State on a one count charge of armed robbery and he was alleged to have, on or about the 5th day of October, 2002, with others at large, severely beaten one Sanusi Ahmed to a state of unconsciousness and robbed him of the sum of N7000.00 while armed with offensive weapons to wit: guns, knives and clubs. The Appellant pleaded Not Guilty and the matter proceeded to trial. The Respondent called six witnesses in proof of its case against the Appellant, including the two victims of the robbery who gave eye witnes…
