JUDGMENT
This is a first appeal from the Judgment of the High Court of Kenya at Nairobi (Ombija, J.) delivered on 24th September, 2015. The appellant had been charged on two counts in the Information dated 14th October, 2008 – murder contrary to Section 203 as read with Section 204 of the Penal Code particulars being that on diverse dates between 8th and 13th September, 2008 at Kihara Shopping Centre in the then Kiambu District he murdered Jane Wanjiru Kagoya. Count 2 related to an offence of attempted suicide contrary to Section 226 of the Penal Code, it being alleged that on 15th September, 2008 at the said shopping centre he attempted to kill himself by taking poison.
Prosecution witnesses were called in support of the case, and the appellant (Isaack Kirugo Komu) gave a sworn statement in defence and, in the end, the trial Judge found that the case by the prosecution had been proved to the required standard.
