ONALAJA, J.C.A. (Delivering the Leading Judgment): The appellant in this case on appeal before this court was arraigned before the High Court Ibadan upon an armed robbery information and charged with statement of offence under section 1(2)(a) of the Robbery and Firearms (Special Provisions) Decree No. 47 of 1970 as amended by the Robbery and Firearms (Special Provisions) Amendment (No.8) Decree of 1974 with the particulars of offence as follows:-

"Particulars of offence

Anthony Isibor (M) on or about the 5th day of April, 1980 along Old Ife Road by the Expressway, Ibadan in the Ibadan Judicial Division armed with offensive weapon to wit fire arm and in the company of other persons unknown robbed one Alhaji Y. A. Afolabi of his Peugeot 504 car with registration No. OYB 2118 A valued at about Nine Thousand Naira (N9,000.00) and a lady's bag containing six hundred naira (N600.00).
