MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A. (Delivering the Leading Judgment): The appellant was arraigned before the High Court of Edo State, sitting at Benin City, in Charge No. B/CD/144C/2013. The appellant and one Ejiro Godwin were charged with the following offences:

That you Ikenna Isibor (m), Ejiro Godwin (m) and others now at large on or about the 21st day of March, 2012 along country home motel road Evbuoriaria, in the Benin Judicial Division conspired among yourselves to commit a felony to wit: armed robbery and thereby committed an offence contrary to Section 6(b) and punishable under Section 1(2)(a) of the Armed Robbery and Firearms (Special Provisions) Act, Cap RII Laws of the Federation 2004.
