(Delivering the Leading Judgment): The Appellant who was the 2nd accused was arraigned with 3 others before the Akwa Ibom State High Court, Eket Judicial Division in charge No. HEK/71/2002 on three counts for robbery contrary to Section 1(2)(a) of the Robbery and Firearms (Special Provisions) Cap. 398, Vol. 22 Laws of the Federation of Nigeria and robbing several people of their money and properties. The charge read as follows:-
