STEPHEN JONAH ADAH, J.C.A. (Delivering the Leading Judgment): This Appeal is against the decision of the Federal High Court sitting at Uyo, CORAM F.O. Riman, J. delivered on the 2nd day of June, 2016.

The case was originated through the instrument of Enforcement of a Fundamental Right.

The Appellant as Applicant in the Court below brought an application for the enforcement of his fundamental right pursuant to the Fundamental Rights (Enforcement Procedure) Rules (2009) where he complained of the breach of his Fundamental Rights to fair hearing and ownership of property under Sections 36 and 44 (1), Chapter IV of the Constitution of the Federal Republic of Nigeria 1999 (as amended).

The reliefs sought by the Appellant were:

a) A DECLARATION that the seizure of the damaged and/or expired goods worth the sum of 300,000.00 (Three Hundred Thousand Naira) belonging to the Applicant by some officers, servants and/or agents and on the authority of the 1st Respondent from his parking store and kept…
