PATS-ACHOLONU, J.C.A. (Delivering the Leading Ruling): Two of thedefendants whose appeal are pending before this court have applied for stay of execution of the judgment of Rhodes-Vivour J. delivered on 6/1/98 pending the determination of the appeal. The subject matter concerns the sum of N909,424.88 which forms part of the estate of the late Chief Festus Okotie-Eboh. The parties to the proceedings had taken part in earlier proceedings relating to the validity of the will of Chief Festus Okotie-Eboh and the Supreme Court gave a decision stating that the will is valid. The matter before the court is an off-shoot of an alleged arrangement amongst the parties as to how to share the money which has run into trouble. The money in question was at first lodged with Lloyds Bank in England but owing to some problems that bank applied to the English court to have the money transferred to the English High Court.
