EBIOWEI TOBI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the Hon. Justice H.Y. Heman of the High Court of Gombe State delivered on the 8th of October 2015 in suit no: GM/62/2014. The facts that culminated into this appeal are as follows: The Appellant, Plaintiff at the lower Court is a businessman and owner of a four-room compound in Gombe. His friend, DW1 introduced him to the 1st Respondent/defendant who served him for 37 years. The 1st defendant alleges that the four-room compound was given to him by the Appellant/Plaintiff as a gift for the years of service. The 1st defendant, in turn, sold the property to the 2nd defendant and subsequently it moved to the 4th defendant. The Appellant vehemently denies making a gift of the property in dispute to the 1st Respondent. The property was demolished by the 4th Respondent when it eventually got to him.
