JUDGMENT  

Plaintiff took out a Writ against the Defendant on the 5th July 2016, for the  following reliefs: 

1. An order of ejectment and recovery of possession of House No. D85  Community 20 Lashibi, Tema (the Premises) for non-payment of rent

2. Recovery of the following amounts (in cedi equivalent): 

a) Rent arrears of US$26, 500 due as at 31st December 2015

b) Mesne Profits of US$ 7, 500 due at 31st May 2016 at US$1,500 per month from 1st January 2016. 

c) Mesne profits at the rate of US$1, 500 per month from 1st June 2016 to the date Plaintiff (Defendant) vacates or is ejected from the  premises. 

3. Interests on amounts claimed in reliefs 2 above. 

Plaintiff’s case is that he entered into a tenancy agreement with Defendant  starting 1st April 2011 at an agreed rent of US$1, 500 per month but Defendant failed to pay the said rent for twenty-one months.
