MISITURA OMODERE BOLAJI-YUSUFF, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Justice, Kwara State delivered in charge no. KWS/10C/2017 on 16/10/2019. The appellant and one other person were charged before the Court on a two count charge of conspiracy and armed robbery punishable under Sections 1(2) and 6(b) of the Robbery and Firearms (Special Provisions) Act, Cap R11, Laws of the Federation of Nigeria (LFN), 2004. They were alleged to have robbed one Alhaja Iyabo Tunde of her hand bag which contained gold earrings, phone and N200,000.00 cash on or about 30th August, 2016.

The appellant was the 1st accused person. To prove its case, the prosecution called four witnesses. The appellant testified in his own defence and called one witness. The prosecution tendered some exhibits including the confessional statements of the appellant. The appellant’s statement made on 30/8/2016 was tendered and admitted as exhibit F without any object…
