ABDULLAHI JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of Ekiti State. Coram: O. Akeju , delivered on the 6th day of June, 2003 in suit No. HAD/50/2000. The appellants were the plaintiffs at the lower court and claimed against the respondents as follows:- “1. Declaration that the purported sale at Ado-Ekiti of the second plaintiff’s house situate, lyingand being at No. 10, Oke-Bola A Street, Ado-Ekiti, by the first and second defendants, to the third defendant on the 10th day of March, 2000 is illegal, unconstitutional, an abuse of the process of the court and therefore, unlawful, null and void. An order of the court revoking the sale.
