This case has a very chequered history.
On the 19th day of September, 2005Mrs Jessie WoetsaNyafliFlammer, (Plaintiff herein) suing per her lawful Attorney,FugahEtseDzename caused to be issued on her behalf, a Writ of Summons accompanied by a Statement of Claim, claiming the following judicial reliefs:
1. Declaration of title to the land as described in paragraph 13 of her Statement of Claim;
2. An order of ejectment and recovery of possession of the portion of Plaintiff (sic) land encroachedupon by defendant without lawful authority and or consent by Plaintiff;
3. Perpetual Injunction restraining the defendant by himself, his assigns workmen agents servants and privies from dealing with any portion of Plaintiff’s land;
4. Damages for trespass.
