JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): This is a motion on notice filed by the Appellant/Applicant pursuant to order 6 Rule 1, and Order 4 Rules 2 of the court of Appeal Rules, 2021 and under the inherent jurisdiction of the court praying for the following:
AN ORDER granting leave to the Appellant to produce further evidence on appeal i.e. the administrative map of Kajuru Local Government Area, Kaduna State showing the Districts and towns therein and also the survey map showing the land in dispute.
Such further or other orders as this Honourable court may deem fit and necessary to make in the circumstances of this case.
The application is predicated on the grounds hereunder stated:
(i) The Appellant was granted leave to amend his notice of appeal on the grounds, inter alia, that the trial Court lacks the jurisdiction to entertain the case between the parties herein, by virtue of the Land Use Act and the Kaduna State (Designation of Land in Urban Area) Order 2015.
