IYIZOBA JCA (Delivering the Lead Judgment): This appeal is against the order of Candide Johnson J., of the High Court of Lagos State, in suit No. LD/3652/99, made on 15 August 2003 as follows:

(i) That the legal reality founded on the material before this court is that the plaintiff is in physical possession and occupation of Plot 1303A, Akin Adesola Street, Victoria Island, Lagos and shall continue in physical possession and occupation until the order of Rhodes-Vivour J. of 26 February 2003 is discharged or set aside.

(ii) It is also directed that if necessary, the Nigeria Police Bar Beach Station shall assist the plaintiff in ensuring that she is not hindered by any of the parties hereto their servants, agents and/or privies from her ingress and or engress to the said premises.

(iii) That any step taken after the court order of 26 February 2003 of Rhodes -Vivours J., inclusive of the purported execution of 20 June 2003 is a legal fiction which cannot be relied upon by any party or …
