J U D G M E N T
This suit began as a straight contest between the 1st Plaintiff and the 1st Defendant on 14th March, 2005, when the 1st Plaintiff issued out a writ against the 1st Defendant then referred to as Agri-Cattle Ltd.
By an application for joinder filed on 13th July, 2005, the 2nd Plaintiff was joined in the action but was referred to as Co-Plaintiff. By another motion for joinder filed on 5th December, 2005, and granted on 15th December, 2005, Nungua Stool was joined as 2nd Defendant in the matter but was also referred to as Co-Defendant. Following the joinder of Nungua Stool, it proceeded to file a statement of defence on 20th January, 2006, to which a reply was filed on 20th February, 2006. It is pertinent to state here that all the two processes were filed before the writ was amended joining Nungua Stool. Be that as it may, the parties later realised this anomaly and, on 9th January, 2007, the Plaintiffs amended the writ joining Nungua Stool as 2nd Defendant. T…
