MUNTAKA-COOMASSIE, JCA (Delivering the Lead Judgment): By a civil summons, dated 31st day of July, 1998, the plaintiff, now appellant, instituted an action at the Federal High Court, Abuja against the three defendants (hereinafter called respondents) and claimed as follows:-

“1. A declaration that the purported termination of plaintiff’s appointment from the service of the Petroleum Equalization Fund (Management) Board is illegal, unconstitutional, null and void for non-compliance with the Federal Government guideline and or circulars on discipline and section 33 of the Constitution of the Federal Republic of Nigeria (as amended) which guarantees the plaintiff’s rights to fair hearing.

2. An order re-instating the plaintiff back (sic) to his position as General Manager (operations) in the Petroleum Equalization Fund (Management Board).
