J U D G M E N T
The plaintiff who is a Ghanaian resident in New York, USA acquired six (6) plots of land lying and being at Ofankor from Nikoi Olai Stool Family of Asere Djorshie, Accra represented by the defendant as its Head and lawful representative. The said Nikoi Olai Family executed an indenture and site plan for the plaintiff after paying an amount of Twenty one Thousand Ghana Cedis (GH₵ 21,000.00). The plaintiff immediately deposited building materials on the land to begin construction. In the course of developing the land his workers were confronted by one Isaac Duah who claimed the land was sold to him by Awuley Monaa Family.
The plaintiff then instituted legal action against the said Isaac Duah. In the course of the said litigation it was revealed that the land in question was acquired by Government for the police to be used as a firing range under the Executive Instrument No. 63/1975.
