HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Plateau State in Suit No PLD/P28/2007 delivered by Honorable Justice D. G. Mann on the 6th of March, 2009. The Appellant was the plaintiff in the lower Court and his claims against the Respondents, as defendants, were for declaration of title to land, injunction to restrain further trespass and damages for trespass.

The case of the Appellant on the pleadings was that he purchased a parcel of land situate at Dengi in 1973 from Idrisu Hassan Dogarai for N150.00 and that this was evidenced by a change of ownership agreement provided by the Kanam Local Government Council and witnessed by several persons including the District Head of Kanam and the Local Government Land Officer.
