EMMANUEL AKOMAYE AGIM, JSC (Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal delivered on 1-8-2018 in Appeal No. CA/PH/194/2014 allowing in part the appeal to it against the judgment of the Federal High Court delivered on 28-10-2013 in Suit No FHC/PH/CS/302/2010.
The parties herein filed, exchanged and adopted their respective briefs as follows - appellant's brief and 1st respondent's brief. The 2nd respondent did file a brief.
The appellant's brief raised two issues for determination as follows-
"Whether the learned Justices of the Court of Appeal were right to hold that the appellant could not challenge the order restraining the 2nd respondent from investigating the 1st respondent over Jumbo Major House Monies because the 2nd respondent did not appeal the said order.
