JAMILU YAMMAMA TUKUR, JCA (Delivering the Leading Judgment):  This is an appeal against the judgment of the High Court of the Federal Capital Territory, Abuja in Suit No: SUIT NO. FCT/HC/CV/1462/2009 delivered on the 20th of January 2020 against the Appellant.

The facts of the matter which culminated in this appeal arose from the belief of the 1st and 2nd Respondents that the property situate at Plot No. 1224, Maitama District, Cadastral Zone AS, Abuja was part of the Estate of Chief Sunday Michael Afolabi since a certificate of occupancy over the property had been granted to the late Afolabi. To protect their interest in the property, the 1st and 2nd Respondents as Plaintiffs before the lower Court vide an Amended Writ of Summons and Amended Statement of Claim dated and filed on 14th March 2011, sought the following Reliefs:
