IBRAHIM SHATA BDLIYA, J.C.A. (Delivering the Lead Ruling): The applicant (KABO AIR LIMITED), filed motion on Notice on the 16th of April, 2017, praying this Court (Court of Appeal, Kaduna Division), for the following Orders:

"1. AN ORDER for extension of time within which it shall appeal against the Ruling/Decision of the lower Court delivered on 20th June, 2016 in suit No. FHC/KN/CS/129/2016.

2. An Order extending time within which the applicant may file its Notice of Appeal against the Ruling/Decision of the lower Court delivered on 20th June, 2016 in suit No. FHC/KN/CS/129/2016.

3. AND for such further or other Orders as the Honourable Court may deem fit to make in the circumstances of this case."

The application is predicated on these grounds:

"1. That the respondent obtained judgment against the applicant before the High Court of Gambia dated 10th December, 2007 in suit No. 169/2000 and same was registered vide an ex-parte application at the lower trial Court.
