OBIETONBARA O. DANIEL-KALIO, J.C.A. (Delivering the Leading Judgment): This appeal is over the Judgment of the Kaduna State High Court (the lower Court) in a land dispute matter. The Respondent in this Appeal Augustine Aneke, was the plaintiff in the lower Court. He sued the defendant at the lower Court, which is the Appellant in this appeal, i.e. the Kaduna State Transport Authority, over the ownership of a piece of land known as plot T. 19 Katsina Road, Kaduna, covered by a Statutory Certificate of Occupancy No. KD/2392 dated 29th August 1996. The Respondent's case at the lower Court was that he purchased the land from one Madam Sa'adatu Bashari. She gave him a Kaduna Local Government Certificate of Occupancy dated 5/10/68. Later he obtained a revised Kaduna Local Government Certificate of Occupancy dated 14th July 1989.
