OJO, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Lagos State, Ikeja Judicial Division in Suit NO. ID/756/2010 between Mr. Lukmon Folorunsho Kalejaye and Ultimate Microfinance Bank Limited delivered on the 21st of July, 2015.
In the judgment, the lower court dismissed the appellant’s claims (then the claimant) and granted the respondent’s counter-claim.
The appellant is dissatisfied with the said decision hence this appeal.
By a writ of summons filed on the 17th of May, 2010, the appellant claimed as follows;
i. A Declaration that the claimant is the bona fide sublessee person to enjoy, in law and equity, the unexpired residue of the term deemed granted by the LBIC in respect of the Flat known and described as Block 135 Flat 1 L.C.H.E. Abesan, Lagos State.
