HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Jigawa State delivered in Case No. JDU/13C/2017 by Honorable Justice M. A. Sambo on the 31st of October, 2018.

The Appellant was arraigned along with three other persons on two counts of conspiracy to commit armed robbery and of committing armed robbery contrary to the provisions Section 97(1) of the Penal Code, Cap. P3 Laws of Jigawa State, 2012 and Sections 1(2) (a) and (b) of the Robbery and Firearms (Special Provisions) Act Cap 398, Law of the Federation 2004. The Appellant was the third accused person and he was alleged to have, with his cohorts, conspired to commit armed robbery and to have attacked on Ma’aruf Abubakar and his wife Zulai Ma’aruf, while armed with offensive weapons, on the 30th of December, 2016 in Kwalam Town, Taura Local Government Area and stolen from them the sum of N300,000.00 and two small radio and two telephone handsets.
