AMINA AUDI WAMBAI, J.C.A. (Delivering the leading Judgment): This appeal is against the decision of the Kano State High Court in Suit No. K/254/2005 delivered on 22nd December, 2005 by Patricia A. Mahmood, J wherein judgment was entered in favour of the respondent.
The respondent Alh. Muhammadu Falalu who was the plaintiff before the lower court, was elected the Chairman of Ungogo Local Government Council of Kano State on the 27/3/2004. In October, 2009, the 1st appellant, (the Kano State House of Assembly), without any complaint against the respondent, passed a resolution recommending to the Kano State Executive Governor, (the 3rd appellant) to suspend the respondent from office and to set up a Judicial Commission of Inquiry to investigate the tenure of the respondent. The said Resolution of the 1st appellant was neither published in its journal nor gazzetted.
Acting on that recommendation of the 1st and 2nd appellants, the 3rd appellant suspended the respondent from office and also …
