MBABA JCA (Delivering the lead Judgment): This is an appeal against the judgment of Adamawa State High Court in suit No. ADSY/ 63/2005, delivered by A. H. Lawal J., on 12 June 2009. Appellant wasthe defendant at the lower court in the suit of the plaintiff, who had filed a writ of summons on 15 October 2005, seeking the following reliefs:

“(a) The sum of N1.8m (one million, eight hundred thousand naira only) being money due from the defendant to the plaintiff as the price of nine (9) plots of land situate at Jambutu Ward, Jimeta,Yola North Local Government Area , belonging to the plaintiff, sold by the defendant on the instructions of the plaintiffs, between 2002 and 2003, which money the defendant failed, refused or neglected to pay the plaintiff despite repeated demands. (b) Interest on the sum of N1.8m (one million, eight hundred thousand naira) at the rate of 25% per annum from 9 July 2003 till judgment.
