RULING
In this application brought pursuant to Order 14 of the High Court Civil Procedure Rules, 2004, CI 47, the Plaintiff seeks against the Defendant an Order for summary judgment.
The grounds of the application are contained in the Affidavit in Support filed by the Plaintiff on 16 May, 2022. Plaintiff is seeking summary judgment for the following reliefs:
a. An order for Plaintiff to recover from Defendants the sum of Forty Tow Thousand Five Hundred and Thirty United States Dollars and Fifty-Eight Cents (US$ 42,530.58) or its Ghana Cedis equivalent being the outstanding amount owed by Defendants jointly and severally to Plaintiff in respect of one {1} Second Hand Liebherr Excavator Model R924C, with serial number 43452 SRM- 3504 which Plaintiff sold and delivered to 1st Defendant on credit terms.
b. An order for Plaintiff to recover from Defendant Interest on the sum of US$ 42,530.58 or its Ghana Cedis equivalent at the prevailing commercial bank lending interest rate from 28th Februa…
