EKANEM JCA (Delivering the Lead Judgment): This appeal is in respect of the interlocutory decision and final decision of the High Court of Lagos State, Ikorodu Judicial Division (“the trial court”) in suit No. IKD/26/2001 delivered on 15 June 2009 and 16 May 2011, respectively. The appellants who were the plaintiffs at the trial court were aggrieved by the interlocutory decision and the final decision of the trial court and they have appealed to this court by way of a notice of appeal filed on 19 A June 2009 (against the ruling) and another notice of appeal filed on 24 May 2011 (against the final decision). The notices of appeal are at pages 347-349 and pages 574-576 of vol. 11 of the record of appeal.
