MOHAMMED MUSTAPHA, JCA (Delivering the Leading Judgment): This is an appeal against the ruling of the High Court of the Federal Capital Territory Abuja Coram Honourable Justice Salisu Garba, delivered on the 27th of November, 2012, by a notice of appeal dated the 27th of November, 2012 and filed on the 27th of November 2012 on the following ground:
