IBRAHIM SHATA BDLIYA, J.C.A. (Delivering the Leading Judgment): By an amended Civil Summons the respondent (Osita Eneh) as the plaintiff instituted suit No.KDC/7cv/2013 against the appellant, (Abodunrin Kehinde) as the defendant before the District Court Kaduna claiming the following reliefs:
(a). An order of Court ejecting defendant from the space the plaintiff rented to the defendant at the frontage of the plaintiff's property situate at No.28 Aliyu Makama Road, Opposite Living Faith Church, Barnawa Kaduna forthwith.
(b) The sum of N100,000.00 as arrears of rent for the period of December 2010 to December 2013 and N4,166.00 per month from December 2013 until the defendant vacates the plaintiff space at the frontage of the plaintiff property at No. 28 Aliyu Makama Road Opposite Living Faith Church, Barnawa Kaduna.
(c) 10% judgment interest in any judgment the Court may enter against the defendant until final liquidation of the said judgment sum.
(d) The cost of prosecuting this case.
