IDRIS, J.S.C. (Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal, Abuja Judicial Division, delivered on the 24th day of May, 2018, coram: Abdul Aboki, JCA, Emmanuel Akomaye Agim, JCA, and Mohammed Mustapha, JCA, in Appeal No. CA/A/530/2013 wherein the court below set aside the judgment of the High Court of the Federal Capital Territory, Abuja, delivered by A. O. Otaluka, J. on the 5th day of June, 2013.
The appellant, who was the plaintiff at the trial court, commenced this action vide a writ of summons dated the 8th day of March, 2012, seeking for these reliefs against the respondents, as defendants as follows:
a. A declaration that the plaintiff is entitled to and the bona fide owner of plots ED1691A and ED1692A covered with rights of occupancy number FCT/MZTP/LA/05/MISC 1281 and right of occupancy No. FCT/MZTP/LA/05/MISC 12812, Cadastral Zone of 07 - 07Extension 1 layout Lugbe Abuja - FCT.
