IGNATIUS IGWE AGUBE, J.C.A. (Delivering the Leading Judgment): This appeal challenges the judgment of the High Court of Benue State, holden at Makurdi in Suit No. MHC/396/2014 delivered by Hon. Justice A.O. Onum on the 1st day of February, 2016 whereof the learned trial Judge granted the counter-claim of the 1st Defendant (now 1st Respondent) and dismissed the claim of the Plaintiff (now Appellant). Dissatisfied with the said judgment, the Appellant appealed to this Honorable Court by a Notice of Appeal predicated on two (2) grounds dated and filed on the 14th of March, 2016 which I set out hereunder albeit without their respective particulars to wit:-
