STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This is a motion on notice filed on the 12th day of October, 2016 praying for the following reliefs:

1. An order granting leave to the Appellant/Applicants to adduce further documentary evidence to show that the 1st Appellant/Applicant did not assume liability over the monetary claims being the subject matter of the appeal, to wit; the purchase and Assumption agreement between the Nigerian Deposit Insurance Corporation (DIC) and the 1st Appellant/Applicant which has already been pleaded in the Applicant's pleadings before the lower court.

ii An order granting leave to the 1st Appellant/Applicant to file further affidavit for use as the further evidence at the hearing of the Appeal.

iii. And for such further or other orders as this Honourable court may deem appropriate in the circumstances.
