NONYEREM OKORONKWO, J.C.A.(Delivering the Leading Judgment): This appeal arose from the judgment of the Oyo State High Court given on 9th day of March whereby Hon. Justice P.O. Ige then of the Oyo State High Court (Now of the Court of Appeal) declared the termination of the employment of the respondent by the appellant as wrongful and awarded some monetary claims to the respondent less those moneys found due to the appellant as claimed in their counter-claim.

Being dissatisfied, the appellants by Notice of Appeal filed 14th March, 2011 appealed to this Court upon 8 grounds of appeal. The judgment appealed from is at pp 226 313 of the record while the Notice of Appeal is at pp 314 317.

From those grounds of appeal, appellant formulated five issues for determination as follows:-

i. Whether the appellants letter of 29th July, 2005 tendered and admitted as Exhibit BB is not a conditional termination of employment of the respondent.
