ERNEST YAO GAEWU, J: This is an application for injunction by the plaintiff for an interlocutory injunction restraining the 1st to 3rd defendants and their privies, assigns, workmen and the officers or howsoever described, from dealing in any way on the land in dispute. I have read the entire processes filed so far in the case including in particular the pleadings, the affidavits in support and against the motion for injunction and I have also taken notice of the documents attached as exhibits and since the grant or otherwise of an injunction is discretionary and having read exhibits 6, 7 and 8 attached to the affidavit in opposition and also having considered exhibit 3 series attached to the affidavit in support of the application, I am of the view that the respondents that is 1st, 2nd and 3rd defendants may have carried out development on the land pursuant to exhibit CA6 of the affidavit in opposition.
